Basic Data
The term
"CSSDR" as used in these terms and conditions refers
to Css Associates Ltd.'s trading title, CSSDR. Anyone who
sends media to CSSDR for diagnostics or data recovery is
referred to as a "Client" or "Customer" in this context.
When discussing
data recovery or the quantity of recovered data, the terms "Full" or
"Full Recovery" refer exclusively to the amount of data that has been
successfully extracted from the media, not to the original data quantity on the
media.
CSSDR promises to assess the client's media for recoverable data and, if
possible, estimate the volume of recoverable data using its best commercial
knowledge and experience as part of the diagnostic process.
CSSDR will make every effort to recover or replicate the client's media's
maximum quantity of data.
The business days
of CSSDR are Monday through Friday, except public holidays. From
9:00 AM to 8:30 PM, we are open for business. Outside of these times, data
recovery services are still available. Outside of these hours, a case-by-case
agreement will be made for any diagnostic and/or recovery services that are
performed.
When it comes to
response times, CSSDR will do everything in their can to keep
them reasonable. Nevertheless, meeting any response times is not a contractual
requirement unless explicitly stated otherwise.
Payments, Quotes, and Estimates
Unless otherwise
specified, CSSDR's fixed price quotations are good for seven
days. The quotation is subject to change after this period without prior
notice.
CSSDR personnel do not include VAT (presently 20% of the total amount
payable) in any prices they quote.
A quotation can be
accepted verbally, in writing, or by electronic mail, fax, or phone. CSSDR will wait for approval before beginning any recovery process.
CSSDR retains the right to charge the customer for any work and/or parts
used up to this point in the event that the client decides not to proceed with
data recovery after consent has been provided. CSSDR retains the
right to choose the exact amount, up to a maximum, that will cover the cost of
the recovery.
Except as
otherwise specified, full payment is required before any data or original media
is released (whether sent, picked up, or downloaded) and after the data
recovery process is finished. Payment options include major credit cards (VISA,
MasterCard, American Express, Switch, Maestro, Electron, etc.), personal or
business checks, or wire transfers to a bank account. On rare situations, CSSDR may need complete payment before releasing any data to the
client.
If payment is not
received by the given due date, CSSDR has the authority to
charge interest and/or administration costs. CSSDR currently
charges a monthly interest rate of 1.5 percent on any outstanding payments. To
give you an idea of the current administration prices, they are as follows:
late payment costs RS:10,000 each calendar month, RS:2000 per phone call about any
outstanding debt, Rs:6000 per letter about any outstanding balance, and RS:2000 per
original invoice copy. Prices do not include g.s.t.
Maintaining privacy
Client consent is
required before any information or data files supplied with, stored on, or
recovered from client equipment may be disclosed to anyone outside of CSSDR, except for agents and employees bound by confidentiality
agreements or as mandated by law, in accordance with CSSDR 's
confidentiality policy.
CSSDR guarantees that it will only employ certified data recovery
specialists and will securely keep any media sent to it at one of its
facilities. The client is aware that the original shipping address and the
storage location could not be the same.
In compliance with
the Data Protection Act of 2018, all data that has been recovered from a
client's media is stored on offline storage devices.
Procedures for Diagnosis and Restoration
Unless otherwise
agreed upon by a representative of CSSDR, all diagnostic reports
are supplied to the client via email or telephone.
The data recovery
process may necessitate physical manipulation of the media, data, or equipment
provided to CSSDR by our professionals. Hence, the customer
understands and agrees that
- The data, media, and equipment have already been compromised,
- Data recovery attempts run the risk of inflicting more harm to the media, data, and equipment.
- The guarantees on the media, data, and equipment might expire, and
- This sort of damage is beyond the control of CSSDR.
CSSDR may need to use extra media to continue the diagnostic phase or
recover data; the client is aware of this. Disk drive replacement components
and specialized adapters and connections are just a few examples. Any
agreed-upon additional media costs will be charged to the client by CSSDR.
CSSDR may, in extremely unusual cases, ask the client to chip in toward the
recovery effort's overall cost. Requests for sophisticated or severely damaged
data recovery jobs will only be considered for this no-obligation, fixed-price
quotation; it is not part of CSSDR's "no recovery, no
fee" service. Customers have the right to refuse this or any other charge
made by CSSDR and ask for their media back. This charge is no
different from any other charge made by CSSDR.
If data cannot be
recovered from the client's media, then CSSDR will not process
any money for the recovery. The customer is aware that complete data recovery
from their media is not always achievable because of how complicated data
recovery is. Without a prior written agreement between the customer and CSSDR, the company does not guarantee that the data it recovers will be
accurate, comprehensive, or otherwise useful to the client.
Any media or
equipment received at any of CSSDR's locations may be sent or
redirected to the most appropriate data recovery facility at any time. This
involves utilizing the laboratory facilities of a parent or affiliate company. CSSDR will then arrange for a courier to deliver the necessary
media or equipment. In order to recover the client's lost data, CSSDR will cover the shipping costs. However, the customer should be aware
that CSSDR cannot be held liable for any damage or loss to
objects that are shipped.
Execution, Transportation, and Delivery
All data that has
been recovered will be returned by CSSDR on an appropriate
medium. This may be anything from an external hard drive, a USB flash drive, or
even a 250 GB FTP download. CSSDR's regular data recovery
service presently limits the amount of data that can be recovered on a USB pen
drive to 230GB. If the amount of data recovered is too large for certain media
types, CSSDR may refuse to provide the data or charge the client
the agreed cost to return the data. In the absence of a written agreement to
the contrary by a representative of CSSDR, the customer shall be
liable for paying an additional sum for any replacement media, on top of the
agreed services fee.
CSSDR uses a next-day traceable service to return all recovered data to the
client. Companies like DHL, UPS, TNT, and FedEx are examples of this.
Nevertheless, alternative arrangements can be made to return the client's data.
The customer may be billed by CSSDR for the cost of the postal
service and any related administrative fees on occasion. The agreed-upon fee
for data recovery is in addition to this.
If there are
delays because of the postal network, CSSDR is not liable.
Unless otherwise agreed upon in advance by CSSDR, no
reimbursement will be provided for loss of profits, inconvenience, etc. in such
cases.
The customer is
obligated to check or arrange for someone to check the provided products as
soon as possible following delivery or attempted delivery, but no later than
five calendar days after delivery or attempted delivery. You are required to
provide CSSDR with written notice within seven calendar days of
delivery if you have any claims regarding shortages in goods delivery or
allegations that the goods do not match the agreed-upon order. CSSDR retains the right to decide how to handle claims that are submitted
after this time frame.
Your recovered data will be kept by CSSDR for seven days starting from the date of shipping. During this time, CSSDR will respond to any questions about the restored data and, if necessary, supply further copies. CSSDR may, at times and with customer approval, keep a copy of your data and/or digital image even after this happens. Data duplication, storage, management, and security may incur fees in these and similar cases, as determined by CSSDR.
If the job is not up to par, the client and CSSDR both agree that CSSDR has the last say over what the client can do about it. In the event that the client is dissatisfied with the results, CSSDR has the option to either
(a) make more attempts to fix the problem or (b) return some
or all of the client's payment.
CSSDR may keep any media delivered to them for data recovery in one of its
overseas offices for up to 14 days after the service is finished. In accordance
with our "Return Drive Policy," you have 28 days from the date we
receive your drive to ask for its Return. The supplied delivery timelines are
computed from the date of recovery plus fourteen days, as the client is aware.

CSSDR cannot be held liable for any media that is lost or destroyed while in transit because our free return service uses regular mail service, which is not a Tracable service. The client is aware that the service is calculated to last 21 days, as shown in equation
You, the client,
are aware that CSSDR makes no promises or representations, and
that the maximum liability that CSSDR can have against you is
the amount that you paid to have your data recovered.
Security of Data
CSSDR does not intend to inspect any files on the client's provided media.
The data integrity percentage is provided by CSSDR. This is just a rough estimate based on the results of a
file signature verification process run by specialized software. Here we
compare the file extensions with the signatures of the recovered files. The
degree of integrity cannot be guaranteed by this method and can vary based on
factors such as the file type and encryption status, among others. This is only
an estimate, not a final figure.
The data
recovered, including its contents, functioning, integrity, corruption, and
usefulness, are not the responsibility or liability of CSSDR in
any way.
While we do our
best to retrieve as much data as possible from any given media and
client-requested files, our recovery process is generic and priced according to
the quantity of data recovered and the amount of labor required to retrieve it.
So, if the client wants to know which files were recovered, they should send an
email or write to their account manager and ask for a file list. It is the
client's obligation to request a file list from CSSDR in writing
or via email 'cssdrhelp@gmail.com' ; otherwise, the list will not be supplied. The restored files are
displayed in the file list. CSSDR does not promise that the data
displayed in the file list or any other data recovered will remain intact.
Conformity with laws
The customer
certifies that they are the rightful owner of any media and content submitted
to CSSDR and that they have the authority to seek data recovery
services in accordance with the laws of England and Wales.
